1. Definitions
In these Terms & Conditions, the following terms have the meanings set out below:
- "Skyhollow" / "we" / "us" / "our" — refers to Skyhollow, with its principal place of business at No. 42, Section 2, Minquan Road, North District, Taichung 404, Taiwan.
- "Service" — refers to any in-home elderly care arrangement provided by Skyhollow, including Light Housekeeping & Comfort, Guided Outdoor Activity, and the Complete Residential Care Package.
- "User" / "you" / "your" — refers to any individual who visits our website, submits an enquiry, or enters into a service agreement with Skyhollow.
- "Agreement" — refers to any written service agreement signed between Skyhollow and a client or their authorised family representative.
- "Website" — refers to https://skyhollen.info and all pages accessible through that domain.
2. Acceptance of Terms
By accessing our website or engaging our services, you confirm that you have read and agree to these Terms & Conditions. If you do not agree, please do not use our website or services. These terms apply to all users aged 18 or above. By engaging our services on behalf of an elderly family member, you represent that you have the legal authority to do so.
3. Service Description
Skyhollow provides in-home care and assistance services for elderly individuals in Taichung, Taiwan. Our services are currently delivered within the Taichung Metropolitan Area. Geographic availability may vary and is confirmed at the time of enquiry. We reserve the right to decline service requests in areas beyond our current operational capacity.
4. User Responsibilities
When using our website or engaging our services, you agree to:
- Provide accurate, complete, and current information when submitting enquiries or entering into service agreements.
- Notify Skyhollow promptly of any material changes in the care recipient's health, needs, or living circumstances.
- Treat Skyhollow caregivers and staff with respect and maintain a safe working environment in the home.
- Not engage or attempt to privately hire any caregiver introduced through Skyhollow for a period of twelve months following the end of any service arrangement.
- Not use our website for any unlawful purpose or in any manner that could damage or impair the site's operation.
5. Service Agreements
All in-home care services are governed by a written service agreement signed prior to commencement of care. The agreement sets out the specific services to be delivered, the agreed fee, and the terms for changes, cancellations, and termination. In the event of any conflict between these Terms & Conditions and a signed service agreement, the terms of the signed agreement shall prevail.
6. Payment Terms
Fees for our services are denominated in New Taiwan Dollars (NT$) and are as set out in the applicable service agreement. Payment is due in accordance with the schedule stated in the agreement. Skyhollow reserves the right to adjust pricing with reasonable written notice, which shall not apply to arrangements already in place under a signed agreement unless renegotiated.
7. Cancellation and Termination
Either party may terminate a service arrangement by providing written notice in accordance with the cancellation period stated in the service agreement. In the event of a serious breach of these terms or a service agreement by either party, termination may occur with shorter notice. Details of refund provisions in cases of termination are set out in the individual service agreement.
8. Intellectual Property
All content on the Skyhollow website — including text, design, layout, and images — is the property of Skyhollow or its licensed suppliers. You may view and print content for personal, non-commercial reference only. Reproduction, redistribution, or commercial use without prior written consent is not permitted.
9. Disclaimers
Our services are provided with care and professionalism, but we do not represent that specific health outcomes will result from any arrangement. Skyhollow provides home care and personal support — we are not a medical provider, and our services do not substitute for professional medical advice, diagnosis, or treatment.
The Skyhollow website is provided "as is" without warranties of any kind regarding its availability, accuracy, or fitness for a particular purpose.
10. Limitation of Liability
To the extent permitted by law in Taiwan, Skyhollow's liability for any claim arising from these terms or a service arrangement shall not exceed the amount paid by you for the specific service giving rise to the claim in the three-month period preceding the claim. We are not liable for indirect, consequential, or punitive damages.
11. Indemnification
You agree to indemnify and hold harmless Skyhollow and its staff from any claims, damages, or expenses arising from your breach of these Terms & Conditions, your provision of inaccurate information, or your misuse of our website or services.
12. Governing Law and Disputes
These Terms & Conditions are governed by the laws of the Republic of China (Taiwan). In the event of a dispute, we encourage you to contact us first at [email protected] to attempt informal resolution. If unresolved, disputes shall be subject to the jurisdiction of the courts in Taichung, Taiwan.
13. Changes to These Terms
We may update these Terms & Conditions from time to time. Changes will be posted on this page with a revised effective date. Continued use of our website or services after the effective date constitutes acceptance of the updated terms.
